Boeing, Southwest Escape Class Suit Over 737 Max Safety Defects

Boeing Co. and Southwest Airlines won’t have to face a class action lawsuit alleging they concealed a serious safety defect in the Boeing 737 Max 8 aircraft.

The plaintiffs couldn’t plausibly allege that they suffered any physical or economic injury from the alleged fraud carried out by Boeing and Southwest, Judge Andrew S. Oldham of the US Circuit Court for the Fifth Circuit said Monday.
