Bob Baffert Asks to Toss Kentucky Derby Bettors’ Class Action

Medina Spirit trainer Bob Baffert asked a federal trial court to dismiss a proposed class action by bettors who allege they were deprived of winnings when the horse was wrongly named the first-place finisher in the 2021 Kentucky Derby, saying he owes them no duty.

The bettors’ negligence claim fails because the Kentucky Horse Racing Commission has enacted regulations “making clear that the disqualification of a horse after the finish of a race is declared official will not affect the pari-mutuel payoff in any way,” Baffert said in a motion to dismiss filed March 25 in the U.S. District Court ...
