BMW Vehicles Have Rollaway Defect, Proposed Class Action Alleges

BMW of North America LLC failed to disclose that X1 vehicles from at least 2023 have a defect that impacts drivers’ ability to control the cars, a new proposed class action alleged.

The rollaway defect causes “a pronounced delay in acceleration,” which can affect driving situations like parking, merging into traffic, and avoiding obstacles, according to the complaint filed Tuesday in the US District Court for the Western District of Virginia. The defect also allegedly causes vehicles to jerk forward unexpectedly and roll forwards or backwards randomly, the complaint added.
