BMW Again Gets Appeals Court to Throw Out $3.7 Million Fee Award

BMW of North America LLC showed that a federal district court improperly awarded a $3.7 million fee award to plaintiffs’ attorneys for work on a class settlement involving allegedly flawed engines, the Third Circuit said Thursday.

The District of New Jersey used a lodestar multiplier to reach this amount without considering constraints required by the US Supreme Court, Judge Cheryl Ann Krause of the Third Circuit said in an opinion to vacate and remand.
