Billionaire Eddie Lampert Denied Appeal Over Additional Damages

Eddie Lampert can’t appeal a Delaware judge’s grant of additional relief to an investment fund that opted into a fiduciary breach lawsuit that leaves the billionaire on the hook for millions in damages.

Lampert’s interlocutory appeal was untimely, doesn’t concern a “substantial issue of material importance,” and doesn’t warrant appellate review, Vice Chancellor J. Travis Laster said in a memorandum opinion. Lampert challenged Laster’s granting of roughly $829,000 in additional relief on top of the nearly $8.9 million in damages he owes to investors.
