Bertolli ‘Extra Virgin’ Olive Oil Suit Crushed

Deoleo USA Inc. convinced a federal court Nov. 8 to dismiss a consumer class action alleging the company’s Bertolli Extra Virgin Olive Oil isn’t actually “extra virgin.”

The suit relied on one study of olive oil quality from 2010. “This meager factual content is not enough for the court to draw the reasonable inference that Deoleo is liable for the misconduct alleged,” Judge Christopher R. Cooper wrote for the U.S. District Court for the District of Columbia.
