Berkshire Insurer Wins Bid Over IVF Testing Class Suit Coverage

A Berkshire Hathaway insurance unit is off the hook for liability coverage of an embryo storage facility facing a class action for fraud and misrepresentation in its advertising of a test used in connection with in vitro fertilization.

Policies issued by Landmark American Insurance Co. to Reproductive Genetics Institute Inc. weren’t triggered by deceptive practices claims in a purported class action suit, Judge Manish S. Shah of the US District Court for the Northern District of Illinois said in a Thursday opinion.
