Barnes & Noble Data Breach Class Action Revived

Barnes & Noble Inc. customers may continue with their data breach class action after the Seventh Circuit held April 11 they have standing to sue.

They may sue to recover the time and money they lost as a result of the 2012 data breach, Judge Frank H. Easterbrook wrote for the U.S. Court of Appeals for the Seventh Circuit.

To combat the possible effects of the data theft, the customers may have paid for credit-monitoring services or lost time dealing with unauthorized withdrawals from their accounts, the court said.
