Bacardi USA Inc. will fight a class action alleging its Bombay Sapphire gin contains a botanical prohibited by Florida law in federal court, the Southern District of Florida ruled Dec. 6.
Uri Marrache originally filed his suit against Bacardi and Winn-Dixie Supermarkets Inc. under the Florida Deceptive and Unfair Trade Practices Act in state court.
The companies removed the case to federal court under the Class Action Fairness Act. Marrache moved to remand.
But he didn’t file his motion within the 30-day deadline for remand, the court said.
