B&G Foods Inc. lost its bid to toss a proposed class action alleging that its Ortega taco shells were falsely advertised as containing zero trans fat, according to a California federal court ruling that cited supporting affidavits about consumer deception.

U.S. District Court for the Northern District of California Judge Jon S. Tigar denied the company’s motion for summary judgment, rejecting the argument that plaintiffs Sabrina Silva and Nancy Schier couldn’t prove materiality, reliance, or causation.
