Avis Car Rental Managers Defeat Bid to Toss Overtime Case (1)

Avis Budget Group Inc. managers who say the car rental company stiffed them on overtime pay survived the company’s dismissal attempt and moved closer to notifying other workers of their proposed wage collective.

The workers sufficiently alleged Avis willfully misclassified them as exempt from the Fair Labor Standards Act’s overtime protections, the US District Court for the District of New Jersey said Thursday. That entitles them to an extended three-year statute of limitations rather than the FLSA’s standard two-year period and makes their claims timely, the Thursday unpublished opinion said.
