Anthem Faces Revived Reimbursement Class Action in California

Anthem Blue Cross and the California Public Employees’ Retirement System must face a would-be class of state employees challenging the methodology for calculating out-of-network reimbursements, after a state appellate court revived some claims in the lawsuit.

Bradley Heinz filed his suit against CalPERS and Anthem on behalf of individuals enrolled in preferred provider organization health insurance plans offered by CalPERS and administered by Anthem.

He alleged causes of action for breach of contract and fiduciary duties, misrepresentation, unfair business practices, and violation of statutory duties. He also asked the court to overturn CalPERS’s denial of his request for additional reimbursement...
