Amazon Loses Bid to Arbitrate Flex Driver’s Wages Suit, for Now

Amazon can’t compel arbitration in a proposed class action claiming that it misclassified and underpaid New Jersey Flex drivers in violation of state law—at least not yet.

Judge Freda L. Wolfson on Tuesday denied Amazon’s motion to compel arbitration in a lawsuit brought by would-be class plaintiff Robert Harper. Harper registered to work as an Amazon Flex Driver through a mobile application in 2019.
