Ohio Intoxicating Hemp Ban Temporarily Halted by State Judge (2)

A judge on Tuesday temporarily blocked Ohio Gov. Mike DeWine’s (R) executive order barring the sale of so-called “intoxicating hemp” products, saying he overstepped his authority.

The executive order uses power reserved for the state legislature and violates the Ohio Constitution as a result, Franklin County Common Pleas Judge Carl A. Aveni said as he blocked it for two weeks. The 90-day ban was briefly in effect Tuesday—meaning smoke shops, breweries, and other retailers couldn’t sell the products—before the judge’s order was issued.
