A Utah company’s complaint alleging Fourteenth Amendment violations — after the state denied it a medical marijuana license — failed to plead its claims sufficiently, the Tenth Circuit ruled Tuesday.
JLPR LLC applied for and was denied one of the 10 medical marijuana cultivation licenses that the Utah Department of Agriculture and Food was allowed to award. It first challenged the denial in state court where the denial was affirmed by the Utah Court of Appeals. Then, it filed a second lawsuit in federal court.
