Nebraska’s secretary of state likely will win an equal protection challenge to the state’s ballot initiative process, the Eighth Circuit said, clearing him to reject the inclusion of a proposal to legalize marijuana on the November ballot.

A split US Court of Appeals for the Eighth Circuit lifted an order that blocked Nebraska Secretary of State Robert Evnen (R) from enforcing the signature distribution requirement for the state’s constitutional ballot initiative process.
