Former FarmaceuticalRX LLC delivery drivers on Tuesday advanced their federal lawsuit claiming the medical marijuana producer denied them overtime wages and terminated them after they complained about it.
The five former drivers plausibly alleged that they were misclassified as independent contractors and improperly denied the overtime wages they’d be entitled to as employees, Judge William S. Stickman IV the US District Court for the Western District of Pennsylvania held. He therefore rejected the motion to dismiss filed by FarmaceuticalRX, several of its officers, and two related companies.
