A federal judge, overseeing claims that Erika Girardi of the “Real Housewives of Beverly Hills” launched a meritless prosecution against her designer over phony credit card fraud allegations, said it’s “common sense” that the designer’s simultaneous claims against the federal government should be dismissed.

Designer Christopher Psaila appears to be “just unhappy” that he was investigated, Judge Michael W. Fitzgerald said Monday while delivering a tentative order, which is not enough of a reason to name the federal government as a defendant in the case.
