- Leading off, Wells Fargo & Co.'s former general counsel, Jim Strother, represented by Orrick Herrington & Sutcliffe, is among five former executives at the bank who say they will fight charges and civil penalties growing out of its bogus account scandal. Ousted Wells Fargo CEO John Stumpf yesterday agreed to an unprecedented ban from the financial industry and to pay a $17 million fine. Regulators levied civil penalties totaling $57 million and said the total could go higher, depending on evidence. A Williams & Connolly lawyer representing Carrie Tolstedt, who led Wells Fargo’s community bank and faces a $25 million penalty, said she will be vindicated after “examination of the facts.” (BN via BLAW) (The Recorder)
- Davis Wright Tremaine hired former Federal Communications Commission deputy general counsel David Gossett as partner in Washington in a new products counseling team. Gossett, a former Mayer Brown partner who was also an assistant GC at the Consumer Financial Protection Bureau, where he helped create and run the litigation group, now advises tech companies launching new products and helps them navigate changing regulation. - A fantasy baseball contestant on online sports betting site DraftKings filed a would-be class action in a Manhattan federal court against Major League Baseball, MLB Advanced Media, the Houston Astros, and the Boston Red Sox over the unfolding sign stealing scandal. (BLAW)
- In an unusual pro bono case, Hogan Lovells, the ACLU and the Innocence Project, and an Arkansas attorney filed a lawsuit on behalf of family seeking evidence that could exonerate defendant Ledell Lee, who already was executed for murder. (WaPo)
- House lawyers told a federal appeals judge yesterday that arguments by President Trump’s legal team in his Senate impeachment trial contradict the Justice Department’s position in two other cases. - Proskauer Rose deal lawyers in 2019 closed more than 230 transactions, up 23%, with a total transaction value of $57.9 billion, up 38%, compared with 2018 levels, the firm said. (BN via BLAW)

- A New York state appeals court revived a class action lawsuit by residents demanding rent rebates from the New York City Housing Authority in compensation for heat and hot water outages during the winter of 2017 to 2018. - Nine migrant parents who were expelled from the U.S. after being separated from their children in 2017 and 2018 returned to the U.S. yesterday after a California federal court granted them “humanitarian parole.” Milbank represented one of them, a Guatemalan man, who was deported by U.S. authorities despite a previous federal court stay order.
