The former chief security officer for Uber Technologies lost his Ninth Circuit appeal to undo convictions for covering up a major 2016 data breach after the court rejected challenges to the jury instructions and evidence.
Joseph Sullivan said the jury should have been instructed to find a “nexus” between his conduct and a pending Federal Trade Commission proceeding for purposes of the obstruction of justice charge. He also claimed that if the basis of the obstruction-of-justice conviction was withholding of information, the government needed to prove he had a duty to disclose that information.
