Texas Judge Fighting Foreclosure Ruling Gets Partial Reversal

A judge for the state of Texas’s highest criminal court convinced a state appeals court to reconsider parts of a judgment that allowed loan servicers to foreclose his homestead.

There are genuine issues of material fact regarding whether lenders Nationstar Mortgage LLC and Shellpoint Mortgage Servicing signed an acknowledgment of fair market value as required under the state’s constitution, the Court of Appeals for the Fifth District of Texas said in a Tuesday opinion.
