Texas Firm Must Return Protected Documents Produced in FCA Suit

Protective discovery orders issued by a district court in False Claims Act litigation don’t bar the Texas-based firm Boyd & Associates from returning confidential documents back to Ocwen Loan Servicing LLC, which produced the materials, the Fifth Circuit ruled Monday.

The protective orders aim to prevent “competitive harm from public dissemination of Protected Information,” rather than to fence off “a producing party from its own documents,” the US Court of Appeals for the Fifth Circuit said in a per curiam unpublished opinion.
