Tesla Loses Bid to Move Harassment, Other Claims to Arbitration

A former Tesla Inc. production associate can pursue all of her discrimination, labor, and wage claims in court, because “the core” of her suit concerns workplace sexual harassment.

The ruling by the US District Court for the Northern District of California is the latest to address the effect of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act on employment and labor litigation generally. The March 2022 law permits workers otherwise bound by employment arbitration agreements to opt out of such contracts and pursue in court a case that relates to a sexual harassment or sexual assault dispute. ...
