An alternative clothing brand convinced a federal appeals court to reopen its copyright suit so a lower court can consider whether to grant it disgorgement of profits as damages.
The district court erred in awarding statutory damages to Dolls Kill Inc. because the Copyright Act allows plaintiffs to choose the type of damages they want to pursue, the US Court of Appeals for the Seventh Circuit said in a Thursday opinion that vacated and remanded the lower court’s judgment.
