A man who said his safety-less pistol discharged while it was in his holster, causing a bullet to hit his left calf, convinced a split Sixth Circuit panel Monday to revive his lawsuit against gunmaker Sig Sauer Inc.
A trial judge was incorrect to fully exclude the opinions of two experts hired by plaintiff Timothy Davis, the US Court of Appeals for the Sixth Circuit said. While their testimony regarding what caused Davis’ pistol to discharge can’t be used, their opinions that Sig Sauer sells its P320 pistol with a design defect are allowed, Judge Karen Nelson Moore wrote. ...
