Rite Aid Gets Claims Over Refusal to Fill Prescriptions Trimmed

Rite Aid Corp. won’t have to fight an emotional distress claim filed by a doctor who said its pharmacies unlawfully refused to fill prescriptions he wrote, a federal court in California said.

Physician Earnest Bonner didn’t allege Rite Aid intentionally engaged in the type of “extreme” and “outrageous” conduct that gives rise to a claim for intentional infliction of emotional distress under California law, nor did he allege he suffered severe distress, the U.S. District Court for the Eastern District of California said Tuesday in dismissing the claim.
