Realtor.com Do Not Call Lawsuit Can’t Advance as Class Action

Move Inc., which operates Realtor.com, convinced a federal court that a plaintiff’s bid to certify a proscribed telemarketing class under the Telephone Consumer Protection Act was fatally flawed and couldn’t be granted.

Priestley Faucett isn’t an adequate or typical representative of the proposed class, and were a class certified, the US District Court for the Central District of California said, individualized issues could predominate because litigants would have to review too many websites to confirm whether people consented to telemarketing.
