A fired New Jersey Institute of Technology professor defended his positive comments about Adolf Hitler and Aryan intellectual superiority as protected by First Amendment, in a bid to revive his wrongful discharge lawsuit.

The oral argument before Judges Cheryl Ann Krause, Paul B. Matey, and Peter J. Phipps probed the free-speech rights of academics and the ability of universities to discipline employees for speech that disrupts the educational environment and school administration or that might do so in the future.
