Peloton Dodges Ninth Circuit Rehearing in ‘Bike+' Trademark Case

The Ninth Circuit rejected a bid to rehear an appeal of Peloton Interactive Inc.‘s win over an app-maker’s “Bike+“ trademark suit.

No reasonable juror could find consumers would likely be confused between World Champ Tech LLC’s and Peloton’s Bike+ apps, a panel for the US Court of Appeals for the Ninth Circuit said in an amended, unpublished opinion issued Thusday with the order denying World Champ’s petition. While some factors favored World Champ, the way consumers encounter the marks in mobile app stores makes it unlikely a consumer would fail to distinguish who made each app, the panel said. ...
