Iowa Immigration Law Block Upheld After 8th Circuit Ruling (1)

An Iowa law criminalizing illegal re-entry into the state was properly blocked by a lower court while a lawsuit challenging the law proceeds, a federal appeals court ruled.

The lower court didn’t abuse its discretion in issuing a preliminary injunction prohibiting enforcement of S.F. 2340 because the plaintiffs showed they had standing and were likely to prevail on the merits, the US Court of Appeals for the Eighth Circuit said Thursday.

The Iowa law clearly interferes with the discretion Congress gives to federal officers charged with enforcing immigration law, Judge Duane Benton said for the three-judge panel.
