Marine Construction Company Keeps NLRB Lawsuit in Texas Court

A California-based marine construction company convinced a federal judge to keep its constitutional lawsuit against the National Labor Relations Board in Texas, allowing it to benefit from highly advantageous circuit precedent.

Judge Marcia Crone, a George W. Bush appointee to the Eastern District of Texas, denied the NLRB’s motion to transfer the Dutra Group’s lawsuit to a California federal court. The company sued the NLRB and various agency officials after it was hit with an unfair labor practice complaint related to a labor dispute based in part on events that took place in Texas.
