Kidney Donor Advances Data Breach Suit Against Organ Network

United Network for Organ Sharing must face most claims of a proposed class action alleging it negligently failed to protect the personal information of organ donors and recipients that was stored in a database available to unauthorized users for 16 years.

Kidney donor Lisa White alleged injuries-in-fact sufficient to establish her standing to sue in federal court, and adequately pleaded claims of negligence, breach of contract, breach of implied contract, and declaratory judgment, Judge Roderick C. Young of the US District Court for the Eastern District of Virginia said Tuesday.
