Justices Decline Bid to Review ‘Equitable Mootness’ Doctrine

The U.S. Supreme Court turned down a real estate investor’s request to review judicial application of the “equitable mootness” doctrine, leaving him unable to continue fighting rulings from the bankruptcy of a Florida hotel project.

Glenn Straub, through financing entity KK-PB Financial LLC, had urged the high court to review the legal quirk, which is frequently invoked to prevent parties from disturbing court-approved bankruptcy plans being implemented. But the justices denied KK-PB’s petition in a list of orders issued Monday.
