Heartland Dental, RingCentral Beat AI Call-Transcription Suit

Heartland Dental LLC and RingCentral Inc. defeated a proposed class action alleging they recorded, transcribed, and analyzed patient calls to their dental-provider clients in violation of the Electronic Communications Privacy Act.

Lead plaintiff Megan Lisota showed that she had standing to sue in federal court, but failed to overcome the defendants’ affirmative defense that they were exempt from ECPA liability under the statute’s exception for interceptions by an electronic-communication service “in the ordinary course of its business,” Judge Lindsay C. Jenkins of the US District Court for the Northern District of Illinois said Tuesday.
