Fourth Circuit Seeks Input on Mandatory Reporter Immunity Limits

The Fourth Circuit asked the Supreme Court of Virginia on Monday whether someone who wrongly reported suspected child abuse without speaking to a state social worker is afforded immunity.

“Given the importance of this issue to the operation of Virginia’s reporting statute and finding no controlling decisions either by the Supreme Court of Virginia or the Court of Appeals of Virginia,” we conclude that certification is warranted, Paul V. Niemeyer said for the US Court of Appeals for the Fourth Circuit.
