Florida Switching to NextGen Bar Admission Exam in 2028

Florida is the 21st jurisdiction to adopt the NextGen bar exam, with state officials announcing they will drop the Multistate Bar Examination starting in July 2028.

State test leaders say the new format will better target legal subjects key to novice lawyer competence, and could include a portion specific to Florida.

“With the discontinuation of the MBE, the overwhelming majority of Florida law schools support the decision to adopt the NextGen exam as a component of the Florida Bar Examination,” Michele Gavagni, executive director of the Florida Board of Bar Examiners, said in a statement Thursday.

  • With more than 111,000 attorneys, Florida is the largest state to adopt the NextGen exam, which like the MBE is produced by the National Conference of Bar Examiners.
  • The new format seeks to rely less on memorization and more on legal analysis than the six-hour, 200-question multiple-choice MBE.
  • While California seeks to create its own test, Florida hopes the NextGen exam will bolster key skills that bar members highlighted in a survey seeking insights on improving attorney education.
