Federal Circuit Lacks Jurisdiction Over ITC Sanctions Appeal

The Federal Circuit tossed out an appeal by Taiwanese chip maker Realtek Semiconductor Corp., ruling that it lacks jurisdiction to review a trade tribunal’s decisions about patent litigation sanctions.

The appeals court ruled that its jurisdiction covers appeals from final decisions by the US International Trade Commission banning imports of patent-infringing products, but not orders about litigation conduct penalties. Realtek had challenged the ITC’s decision denying it attorneys’ fees following dismissal of a dispute filed by Future Link Systems LLC, a unit of the patent monetization firm IPValue Management Inc.
