EPA Backs Biden Rule Subjecting ‘Forever Chemicals’ to Superfund

The EPA has decided to support a Biden-era regulation that made two “forever chemicals” subject to the reporting and liability provisions of Superfund.

“Consistent with EPA’s commitment to combat PFAS contamination, EPA has decided to keep the CERCLA Designation Rule in place,” John Evans, a senior adviser in the Environmental Protection Agency’s Office of Land and Emergency Management, wrote in a declaration that accompanies the agency’s motion filed with the US Court of Appeals for the District of Columbia Circuit.
