Somatics LLC convinced a federal appeals court not to reinstate claims from a man who says electroconvulsive therapy led to brain damage that caused memory loss.
The US Court of Appeals for the Eleventh Circuit on Monday affirmed the lower court’s ruling granting Somatics, the maker of the ECT machine, summary judgment.
Plaintiff Jeffrey Thelen brought product liability and negligence claims against Somatics after receiving nearly 100 ECT treatments for severe depression. Thelen said he suffered severe memory loss and was later diagnosed with a neurocognitive disorder.
