A home designer failed to convince the Eighth Circuit to revive his claims that realtors infringed his copyrights by leaving his floorplans available online after homes were sold.
Charles Lawrence James and his company Designworks Homes Inc. failed to overcome the realtors’ fair use defense because using the works to inform buyers of the layout was a completely different purpose than designing homes, the US Court of Appeals for the Eighth Circuit said in a Tuesday opinion.
