A Minnesota state lawmaker and a social-media content creator who argued for a preliminary injunction to block enforcement of the state’s law prohibiting AI-generated deepfake political videos faced a skeptical Eighth Circuit panel Wednesday.
Plaintiffs’ attorney Adam E. Schulman of the Hamilton Lincoln Law Institute argued a lower court was wrong to deny an injunction because his clients faced the immediate threat of enforcement despite the state’s assertions to the contrary. But Judge Steven M. Colloton asked why the plaintiffs created delay by appealing that ruling rather than litigating the case to a final judgment.
