• GAO upholds $55 million technical support award to Command Post
• Protesters couldn’t demonstrate conflict of interest or flawed tradeoff decision, GAO says
Command Post Technologies Inc. will perform a $55 million technical operations support contract for the Defense Information Systems Agency despite protests from competitors that offered lower bids, the Government Accountability Office said.
Protesters Superlative Technologies Inc. and Atlantic Systems Group Inc. couldn’t show that the award was tainted from a conflict of interest due to Command Post relying upon Booz Allen Hamilton Inc. as a subcontractor, the GAO said.
The protesters also failed to show that the agency conducted an unreasonable best-value tradeoff analysis before choosing Command Post and its 44 percent price premium, the GAO ruled.
An agency may select the higher-rated, higher-priced quotation as reflecting the best value to the agency if that decision is consistent with evaluation criteria and the agency reasonably determines that the technical superiority outweighs the price difference, the GAO said.
Pillsbury Winthrop Shaw Pittman LLP and Marshall & White PLLC represented the protesters. K&L Gates LLP represented Command Post Technologies Inc.
The case isSuperlative Techs. Inc., GAO, B-415405, 1/5/18, decision released 1/29/18.
