Carbon Pipeline Company Urges Supreme Court to Reject Iowa Case

A carbon dioxide pipeline company urged the US Supreme Court against taking on a case from two Iowa counties challenging a court’s decision that federal law preempts their local safety regulations.

Summit Carbon Solutions LLC argued in its brief filed Tuesday that Shelby and Story Counties’ ordinances required pipeline operators to submit emergency response plans meeting federal Pipeline and Hazardous Materials Safety Administration rules.

The counties sought to impose minimum pipeline distances from schools, hospitals, and residences—safety standards explicitly overruled by federal law, the brief said.
