Burford May Keep Pursuing Its Claims in Turkey Antitrust Suit

A federal judge allowed litigation finance company Burford Capital to pursue antitrust claims against a group of turkey processors who argued courts should stop litigation funders from pursuing claims for their own benefit.

Nothing in federal law or public policy precludes Burford from bringing the case, wrote US District Judge Sunil Harjani on Monday. Burford’s role as the owner of the claims is less concerning than situations where funders and plaintiffs might pursue claims together, which is when funders may inappropriately control case decisions, the judge wrote.
