Attorney Sanctioned Over Destroyed Evidence in Employment Case

Proposed sanctions against an attorney and his client have been affirmed by a federal judge who found that they “intentionally spoliated” or destroyed evidence and engaged in discovery misconduct.

The plaintiff in the underlying suit against the Chicago Transit Authority, George Pable, and his lawyer Timothy A. Duffy, were ordered by Judge Robert W. Gettleman with the US District Court for the Northern District of Illinois, to pay about $37,000 and $112,000 respectively in sanctions for destroying electronically stored information including messages on Signal, an independent messaging app.
