Associated Wholesale Grocers Beats Second Suit Over 2023 Breach

Supermarket supplier Associated Wholesale Grocers Inc. defeated another proposed class action over a 2023 data breach less than a year after a different federal judge in the same court dismissed a similar suit.

Lead plaintiff Toriana Patterson, a former AWG employee, lacks standing to pursue damages based on either past or future identity theft, Judge Eric F. Melgren of the US District Court for the District of Kansas ruled Thursday. Her allegations of emotional distress, loss of privacy, and time spent mitigating risk failed to confer standing because she failed to connect her injuries to the breach, he said.
