Minnesota’s law prohibiting excessive price hikes on generic drugs will remain paused after a federal appeals court on Friday declined to reconsider its decision affirming a lower court’s preliminary injunction on the statute.
The US Court of Appeals for the Eighth Circuit issued a written order denying Minnesota Attorney General Keith Ellison’s (D) request for either a three-judge panel or the full court to rehear the case. The court, which ruled in June that the Minnesota law likely violates the dormant commerce clause of the US Constitution, didn’t include an explanation for its decision in the two-sentence order.
