ANALYSIS: Workplace Biometric Collection Lawsuits Up in Q2

The number of employment-related BIPA complaints in federal court last quarter far outpaced the number of consumer-related complaints, a reversal from Q1. Despite the flip, the number of Illinois Biometric Information Privacy Act (BIPA) lawsuits remains historically low.

Ten of the 13 federal court complaints in Q2 were employment related, similar to numbers seen in 2023. For years,consumer-related complaints dominated BIPA litigation in federal court.
