Federal complaints involving per- and polyfluoroalkyl substances (PFAS) jumped dramatically in 2020, and continue to be filed in large numbers. The US Environmental Protection agency has already begun to regulate PFAS, with more on the horizon—likely leading to more litigation.

But the success of these future suits could hang on challenges to the EPA’s authority to act.
