ANALYSIS: Gig Driver Class Actions Break Trend in 2019

After suffering several years of defeats in federal court, gig drivers spent 2019 pressing class claims following a Supreme Court decision that helps them avoid arbitration.

The decision has resulted in courts beginning to divide gig drivers into different categories for the purpose of determining the arbitrability of their claims. It will also likely lead gig employers to rely more heavily on state arbitration laws rather than the Federal Arbitration Act (FAA) to try to keep driver claims out of court, where they risk creating unfavorable precedent on several important issues.
